An Oregon babysitter, Markell Hilaire, made headlines for striking and smacking a 1-year-old left in his attention is making headlines. Because the court failed to charge him due to an Oregon law that is antiquated, this time, it’s.

The baby, Jacob, was left with bruises that were visible around his small face as well as a black eye. He was also left with the the depression of Hilarie’s palm from where he strike on him. Multiple physicians that examined the infant as well as the Sheriff said the beating could have killed the young kid.

Because the young lad was not able to say he was mistreated, the charges were deferred. This really is due to a 2012 Oregon Court of Appeals ruling that said, ‘a victim must be able to characterize the attack.’ The parents, Alicia Quinney and Joshua Marbury, are rightfully furious that their sons attacker WOn’t be served justice in court.

The courageous parents made a Facebook post about their scenario expecting it would go viral and bring attention to their own sons case, and decided to take matters in their own hands.

Marbury’s post outlined the worry that their family has been under since the assault on their kid. He also emphasized the fact that medical personnel and law enforcement saw the signs of the abuse and made it clear his son could of died.

He drew on a parallel suggesting that if an adult was found mistreating another one, they might be taken to jail right away. He poignantly completed his post away with ‘After TWO months of waiting we just find out that charges were lost BECAUSE my one year old cannot tell you verbally he was abused and my son did not reveal he was in pain OR that this man ‘intentionally did this.’ ‘

A Change.org petition was shortly established after the fathers post asking for a change on the 2012 law. It garnered over 55,000 signatures. Since then, Markell Hilaire continues to be detained according to the district attorney. On what charges the court supplied him with details weren’t given out. He has been held in custody on $10,000 bond. The son’s mother posted on Facebook ‘At this stage our case is in the control of the justice system.’
